1. Acceptance of these terms
By using this website, contacting NurtureCare, or purchasing NurtureCare services, you agree to these Terms & Conditions and any service-specific terms presented during enrollment or onboarding.
2. Nature of the service
NurtureCare provides non-medical remote support by phone and email. Services may include scheduled wellness check-in calls, reminders, written call records, family alerts, escalation procedures, companion calls, and non-medical care coordination.
NurtureCare does not diagnose, treat, prescribe, administer medication, provide clinical advice, make medical decisions, provide in-person care, or continuously monitor any individual.
3. Emergency situations
NurtureCare is not an emergency response service. We only know what occurs during scheduled interactions or communications received by our team. We have no continuous visibility between calls. In an emergency, users should call 911 or the appropriate local emergency service immediately.
4. Account holder responsibilities
The account holder is responsible for providing accurate contact details, schedules, authorized contact lists, and escalation instructions. The account holder is also responsible for updating NurtureCare when information changes.
The account holder represents that they are authorized to provide the information submitted to NurtureCare and to identify individuals who may receive service-related communications.
5. Consent of the person receiving calls
The person receiving NurtureCare calls must be willing to receive them. If that person asks NurtureCare to stop calling, we may pause or discontinue calls and notify the account holder or an authorized contact.
6. Plans, pricing, and add-ons
Current plan descriptions and pricing are published on the Plans page. Unless otherwise agreed in writing, services are billed monthly. Optional add-ons may carry separate fees. Pricing, plan features, and availability may change prospectively, but changes will not retroactively alter charges already incurred.
7. Changes, pauses, and cancellation
Plans may generally be changed or cancelled with 30 days' notice, consistent with the service information provided during enrollment. Temporary schedule pauses may be available for travel or other planned absences. Any billing treatment for a pause will be confirmed when the pause is requested.
8. Call schedules and service availability
We make reasonable efforts to place calls within the agreed schedule and service hours. Service may occasionally be delayed or interrupted by staffing issues, telecommunications failures, internet outages, severe weather, emergencies, or other circumstances outside our reasonable control.
9. Escalation procedures
Escalation instructions are established during onboarding. When a scheduled call is missed or a concern is raised, NurtureCare will follow the applicable instructions and authorized contact sequence on file. We cannot guarantee that an authorized contact, emergency service, or other third party will answer or respond.
10. No guarantee of outcomes
NurtureCare provides communication and documentation services, not guaranteed health, safety, medical, or personal outcomes. A completed call, reminder, alert, or escalation does not guarantee that a person will follow advice, attend an appointment, take medication, remain safe, or avoid an adverse event.
11. Website and communications
The website is provided for general information and service administration. Information on the website may be updated from time to time. Email and website forms should not be used for emergencies or for transmitting highly sensitive information unless specifically directed through a secure process.
12. Intellectual property
Unless otherwise stated, the NurtureCare name, website content, text, graphics, branding, and original materials are owned by or licensed to NurtureCare and may not be copied, republished, or commercially used without permission.
13. Employment information
Job postings are invitations to apply and are not offers or guarantees of employment. NurtureCare may modify, close, or place roles on hold at any time. Applicants should never pay a fee to apply or provide bank or identity information during the application stage.
14. Third-party services
NurtureCare may rely on third-party telecommunications, hosting, email, software, payment, payroll, or other service providers. We are not responsible for the independent acts, omissions, outages, or privacy practices of third-party services beyond our obligations under applicable law and contract.
15. Limitation of liability
To the fullest extent permitted by applicable law, NurtureCare will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or services. Nothing in these terms excludes liability that cannot legally be excluded.
16. Indemnification
To the extent permitted by law, users agree to be responsible for losses or claims arising from information they provide without authorization, misuse of the service, or violation of these terms.
17. Governing law
These terms are intended to be interpreted under the laws applicable to NurtureCare's principal place of business, without regard to conflict-of-law rules. The specific state and venue should be confirmed before final publication if NurtureCare wishes to designate a particular jurisdiction.
18. Changes to these terms
We may update these Terms & Conditions from time to time. The effective date above will be revised when changes are posted. Continued use of the website or services after an update constitutes acceptance of the revised terms to the extent permitted by law.
